These Terms and Conditions govern your use of the SERPrecon service (the "Service"), a software as a service (SaaS) product that uses information retrieval techniques to analyze your website against competitors in the search results and provide recommendations. By accessing or using the Service, you agree to be bound by these Terms and Conditions.

The Service allows you to collect and analyze data related to your website's search engine performance. You acknowledge that the Service is provided on an "as is" basis and that we do not guarantee the accuracy, completeness, or timeliness of the data provided.
3. User Accounts
To use the Service, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for any activity that occurs under your account.
4. Intellectual Property
SERPrecon and its related trademarks, logos, and service marks are the property of SERPrecon LLC.. You agree not to reproduce, modify, distribute, or otherwise exploit any of our intellectual property.
5. Data Collection and Use
The Service may collect certain information from you, including your email address, name, and credit card information. We use this information to:
Create and manage your user account
Process payments for your subscription
Provide customer support
Improve the Service
We may also collect publicly available data about your website's search engine performance. This data is used to generate reports and recommendations.
We may also collect and store information from your website (titles, headings, copy, links, etc) for the purpose of providing the service. SERPrecon reserves the right to use this website copy in an anonymized/aggregated manner to perform additional related analyses.
6. Payment
The Service may require a monthly subscription fee. You agree to pay all fees associated with your subscription in accordance with our payment terms. We use Stripe to process credit card payments.
6.5 Credits
The service uses credits for report creation. SERPrecon reserves the right to make changes to the credit and pricing system at our sole discretion. Currently, unused credits will not be refunded, prorated, or exchanged.
7. Termination
We may terminate your access to the Service at any time, for any reason. You may terminate your subscription at any time by contacting us. Upon termination at your request, unused credits will not be refunded.
8. Disclaimer of Warranties
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.
9. Limitation of Liability
IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH THE USE OR INABILITY TO USE THE SERVICE.

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles.

We may update these Terms and Conditions from time to time. Any changes will be effective upon posting. Your continued use of the Service after such changes have been posted constitutes your acceptance of the modified Terms and Conditions.
